In consideration for the right to use the facilities owned or controlled by either Fit Loft, LLC dba The Fitness Loft or Axon Fitness, LLC dba Axon Group and Personal Training (each a “Facility” or collectively the “Facilities””), the undersigned agrees that he/she shall be liable for any property damage and/or personal injury caused by the undersigned and its invitees at the Facilities or at any activities or functions operated, arranged or sponsored by Fit Loft, LLC or Axon Fitness, LLC.. It shall be the obligation of the undersigned to pay for any costs so incurred and arising out of such liabilities upon presentation of a statement thereof. The undersigned further agrees that his/her use of the Facilities, or participation in, activities operated, arranged or sponsored by Fit Loft, LLC or Axon Fitness, LLC  either located at a Facility or elsewhere, shall be AT THEIR OWN RISK, and neither Fit Loft, LLC nor Axon Fitness, LLC shall have any liability for any injuries or damages to the undersigned, or the property of the undersigned, or be subject to any claim, demand, injury or damages and the undersigned hereby waives and releases any and all claims they may have against Fit Loft, LLC and Axon Fitness, LLC related thereto. Furthermore, the undersigned individually, and on behalf of the undersigned's personal representative, heirs, administrators, assigns and successors does here by expressly forever release and discharge Fit Loft, LLC and Axon Fitness, LLC, their successors and assigns, as well as their officers, agents and employees, from all claims, liabilities, demands, actions, or causes of action related to or arising out of the undersigned membership with either Fit Loft, LLC or Axon Fitness, LLC, use of the Facilities or participation in any .events, activities or functions operated, arranged or sponsored by Fit Loft, LLC or Axon Fitness, LLC.
I acknowledge that Fit Loft, LLC or Axon Fitness, LLC, or affiliated persons working for or on behalf of Fit Loft, LLC or Axon Fitness, LLC will periodically be taking photographs and recording video both inside and outside of the Facilities without prior notice. I agree that my likeness recorded in the form of photographs and videos maybe be used by Fit Loft, LLC or Axon Fitness, LLC or both for promotional purposes and that all photographs and videos containing my likeness are the sole property of Fit Loft, LLC.

Fit Loft, LLC or Axon Fitness, LLC or both has my permission to administer emergency procedures or seek medical attention for me in the case of an emergency, and I hereby release and discharge Fit Loft, LLC and Axon Fitness, LLC, their successors, assigns, officers, agents, and employees, from all claims, liabilities, demands actions or causes of action that may be related thereto.

I expressly agree that this release, waiver, and indemnification agreement is intended to be broad and as inclusive as permitted by the laws of the state of Ohio and that if any portion of thereof is held invalid, the balance shall, notwithstanding, continue in full force and effect.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND FIT LOFT, LLC DBA THE FITNESS LOFT, AND/OR AXON FITNESS, LLC DBA AXON GROUP AND PERSONAL TRAINING, AND PERSONS OR ORGANIZATIONS AFFILIATED WITH FIT LOFT, LLC OR AXON FITNESS, LLC, AND I HAVE SIGNED THIS FORM ON MY OWN FREE WILL.
